By accessing or using Callabash ("the Service"), operated at callabash.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Callabash is an AI-powered content discovery platform that scans curated sources and delivers personalized email digests based on your learning interests. The Service includes topic management, content matching, AI-generated summaries, and analytics features.

3. Accounts

You must sign in using a supported social login provider (Google, LinkedIn, or Apple). You are responsible for maintaining the security of your authentication credentials. You must be at least 16 years old to use the Service.

You agree to provide accurate information and to notify us if you believe your account has been compromised. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans & Billing

The Service offers Free, Pro, and Scholar tiers. Free accounts have limited features as described on our pricing page. Paid subscriptions are billed monthly or annually through Stripe.

  • Subscriptions auto-renew unless cancelled before the end of the current billing period.
  • You can cancel anytime through the billing portal. Access continues until the end of the paid period.
  • We offer a 14-day money-back guarantee on first-time paid subscriptions. Contact us at hello@callabash.ai to request a refund.
  • Prices may change with 30 days' notice. Existing subscriptions are honored at the original price until renewal.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Scrape, crawl, or use automated means to access the Service beyond the provided API
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple accounts to circumvent usage limits
  • Redistribute digest content commercially without permission

6. Content & Intellectual Property

Your content: You retain ownership of any content you provide (topic descriptions, custom RSS feeds, feedback). By using the Service, you grant us a license to process this content as necessary to provide the Service.

Third-party content: Digest items contain summaries of and links to third-party articles. We do not claim ownership of this content. Summaries are AI-generated for informational purposes. Always refer to the original source for authoritative information.

Our content: The Callabash name, logo, website design, and AI-generated insights are our intellectual property. You may not reproduce or redistribute them without permission.

7. API Access

Scholar plan subscribers may access the Service via our API. API usage is subject to rate limits and fair use. We reserve the right to throttle or revoke API access for abuse or excessive usage that degrades service for others.

8. AI-Generated Content

The Service uses AI (Anthropic Claude) to generate summaries, relevance insights, and recommendations. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. AI outputs are provided for informational purposes only and should not be relied upon as professional, legal, medical, or financial advice.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service with reasonable notice. Scheduled maintenance will be communicated in advance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Callabash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

You may delete your account at any time. We may terminate or suspend your access for violation of these terms, with notice where practicable. Upon termination, your right to use the Service ceases immediately, though we will retain your data for 30 days to allow for account recovery.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
